The twelve days of UPC - one week down, five days to go!

We are one week into our twelve days of UPC video series, where we are releasing daily bite-sized videos that explore key aspects of UPC decisions and their implications, while unpacking complex legal developments in a way that’s accessible and informative. The series concludes with the launch of our UPC Review of the Year publication, now in its second year.

Day 1: To get the series underway, Brian Cordery and Naomi Hazenberg delivered their very own 2025 UPC carol. 

Day 2: Patrick Newlands dived into one of this year’s hottest UPC talking points – the court’s growing “long-arm jurisdiction” following the landmark CJEU decision in BSH v Electrolux.

Day 3: Charlie French shone a spotlight on one of this year’s most action-packed UPC topics: preliminary injunctions (PIs).

Day 4: James Boon took a tour through some of the UPC’s decisions on remedies – from proportionality to enforcement penalties.

Day 5: With several key orders this year, the UPC is scrutinising financial health, enforcement risks for non-EU parties, and setting security amounts from €56K to €600K. The Court of Appeal has clarified who can request security and timing matters. Lucy Sewter explained more in this episode.

Day 6: Infringement by equivalents has been a hot topic this year at the UPC, and courts are circling around one key question: does the substitute means perform the same technical function to achieve the same effect? Eden Winlow provided an overview in this one.

Day 7:  James Boon dived into one of the UPC’s trickiest (and most hotly debated) areas: Standard Essential Patents and FRAND.
