Currently a UK designation of an International Application filed with WIPO automatically extends to Jersey. However, from 1 August 2026, Jersey will no longer be covered as part of a UK designation. It will therefore be necessary to select Jersey as a separate designation if a trade mark applicant wishes to obtain trade mark protection in this particular Channel Island. Applicants must declare an intention to use the trade mark, which is also the same requirement that exists for the UK.
Jersey will also have its own office of origin which means that applicants based in Jersey can file their International Application through the Jersey Registrar of Intellectual Property.
What about existing International Registrations? For those that designate the UK and are recorded before 1 August 2026, WIPO will automatically record a Jersey designation. If the UK designation is still pending, WIPO will only record a Jersey designation once the UK issues a statement of grant of protection.
